1. Description of Goods and Services

SAPawn (www.sapawn.co.za) is an online marketplace that connects buyers with registered South African pawn shops selling forfeited and pre-owned goods. Each item listed for sale is sold by an individual pawn shop (“the Seller”), identified on the item listing and at checkout. SAPawn acts as the marketplace platform facilitating the transaction.

All goods sold on SAPawn are second-hand/pre-owned items that have been legally forfeited or acquired by registered pawn shops in accordance with South African law, including the National Credit Act and the Second-Hand Goods Act.

SAPawn is a business in the second-hand goods / pawnbroking industry that offers an online marketplace for the sale of forfeited and pre-owned goods from registered pawn shops across South Africa.


2. Delivery Policy

Once SAPawn has verified your EFT payment (typically within 1 business day), the seller is notified to release the item. Three delivery options are available at checkout:

  • Collection from Shop: Free of charge. The seller’s address is shown on your order confirmation. You collect in person.
  • Buyer-Arranged Courier: You book and pay your own courier (e.g. Uber, Bolt, a private driver, or any courier of your choice) directly. SAPawn provides you with the seller’s pickup address; all courier arrangements and costs are between you and your courier. SAPawn charges no fee for this option.
  • Shop-Arranged Delivery: The seller sources a courier and contacts you with a delivery quote on the phone number provided at checkout. If you accept the quote, the seller dispatches the courier and the additional cost is settled directly between you and the seller. If you do not accept the quote, your order is cancelled and refunded from SAPawn’s escrow account, less a 1% administrative fee to cover payment-processing and platform costs. Risk of goods passes to the buyer upon delivery, collection, or hand-off to a buyer-arranged courier (whichever applies).


3. Returns and Refunds Policy

Due to the nature of second-hand goods, all items are sold “as-is” unless otherwise stated by the seller. However, the following consumer protections apply:

  • Cancel before payment is verified: While your order is Reserved (awaiting POP) or after a rejected POP, you can cancel from your order tracking page at no cost. The item is released back to the marketplace and no money has moved.
  • Cancel after payment but before delivery: You can request a refund from your order tracking page. SAPawn refunds the order from its escrow account, normally within 2 business days. A 1% administrative fee may apply where the cancellation is due to rejection of a shop-supplied delivery quote, to cover payment-processing and platform costs.
  • Cooling-Off Period (Section 44 of the CPA): For online purchases, you may cancel and return the goods within 5 (five) business days of delivery for a full refund, with no administrative fee, provided the goods are returned in the same condition as received.
  • Condition: Items must be returned in the same condition as received, with all original accessories and packaging where applicable.
  • Defective Goods: In terms of Section 56 of the CPA, if goods are found to be defective within 6 months of delivery, you are entitled to a repair, replacement, or refund at the seller’s discretion.
  • Refund Method: Approved refunds are paid by EFT into the bank account from which the original EFT was received, normally within 2–5 business days of approval.

4. Export Restriction

The offering on this website is available to South African residents only. We do not ship internationally. All transactions are conducted within the borders of the Republic of South Africa.


5. Privacy Policy

SAPawn shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “Personal Information” shall be defined as detailed in the Protection of Personal Information Act 4 of 2013 (POPIA).

6. Payment Options

Payment is made by EFT (electronic funds transfer) into SAPawn’s escrow bank account. SAPawn does not currently process credit card payments and does not store any card information.

The flow is:

  1. You complete checkout. The item is reserved for you for 1 hour.
  2. SAPawn shows its bank details and a unique payment reference on the next page.
  3. You transfer the total amount via EFT from your banking app, using the reference shown.
  4. You upload a screenshot of your bank confirmation (Proof of Payment) on the same page.
  5. SAPawn verifies the payment against its bank statement, then notifies the seller to ship or prepare the item for collection.
  6. Your money is held in SAPawn’s escrow account until you confirm receipt — if anything goes wrong before delivery, SAPawn refunds you from escrow.

7. Buyer Information

You provide your name, email, phone number, and delivery preference at checkout. SAPawn does not require you to create an account or set a password. The email address you provide is the key by which you can later find your orders (see the Find My Orders link in the marketplace header). SAPawn never sees, stores, or has access to your card details because no card payment is involved.


8. Merchant Outlet Country and Transaction Currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).


9. Responsibility

SAPawn takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods. Individual sellers (pawn shops) remain responsible for the physical fulfilment and condition of goods.


10. Country of Domicile

This website is governed by the laws of South Africa and SAPawn chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature:

11. Variation

SAPawn may, in its sole discretion, change this agreement or any part thereof at any time without notice. Changes will be posted on this page with an updated “Last updated” date. Continued use of the website constitutes acceptance of the amended terms.
