SAPawn (www.sapawn.co.za) is committed to protecting your personal information. This Privacy Policy explains how we collect, use, store, and protect your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable South African legislation.
2. Information We Collect
We may collect the following personal information when you use our services:
- Identity Information: Full name, email address, phone number
- Delivery Information: Physical address, city, postal code, delivery notes
- Transaction Information: Purchase history, EFT payment references, order details
- Proof of Payment Files: Screenshots or PDF confirmations of your bank transfer that you upload during checkout (held for 5 years for tax / accounting purposes per South African legislation)
- Technical Information: IP address, browser type, device information, cookies
- Communication Information: Inquiry messages, chat messages, support requests
Important: SAPawn does not collect, process, or store any credit or debit card information. All payments are made by EFT (electronic funds transfer) from your banking app directly into SAPawn’s escrow bank account — the same way you pay any business by bank transfer. Your card details are never involved.
3. How We Use Your Information
Your personal information is used for the following purposes:
- Processing and fulfilling your orders
- Communicating with you about your purchases, deliveries, and inquiries
- Connecting you with the selling pawn shop for order fulfilment
- Sending order confirmations, delivery updates, and payment receipts
- Improving our website, services, and user experience
- Complying with legal obligations
- Preventing fraud and ensuring security of transactions
4. Third-Party Sharing
We may share your personal information with the following third parties:
- Selling Pawn Shops: Your name, contact details, and delivery information are shared with the pawn shop fulfilling your order so they can process collection or delivery.
- SAPawn’s Bank: When you transfer your EFT payment, your bank shares standard transaction metadata (sender name, reference, amount) with SAPawn’s bank in the normal course of clearing the payment. SAPawn does not see your bank account number unless you upload a Proof of Payment screenshot that contains it — in which case it is retained as part of the order record.
- Couriers (only if used): If you select “Shop arranges delivery,” the seller may share your delivery address and contact details with the courier they engage to deliver your item. If you select “I’ll arrange my own courier,” SAPawn does not share your details with any courier — you do this directly.
- Law Enforcement: We may be required to share information with the South African Police Service (SAPS) in accordance with the Second-Hand Goods Act and other applicable legislation.
We do not sell, rent, or trade your personal information to any third parties for marketing purposes.
5. Data Retention
We retain your personal information for as long as is necessary to fulfil the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements. Transaction records are retained for a minimum of 5 (five) years in accordance with South African tax and financial legislation.
6. Your Rights Under POPIA
You have the right to:
- Request access to the personal information we hold about you
- Request correction of inaccurate or incomplete information
- Request deletion of your personal information (subject to legal retention requirements)
- Object to the processing of your personal information
- Lodge a complaint with the Information Regulator (South Africa)
